Understanding Physical vs. Legal Custody
Every state handles child custody and visitation rights in a different way. In the state of South Carolina, there are two main types of child custody to consider: legal custody and physical custody. Where legal custody refers to the parental right to make decisions about education, health care, and welfare for your child, physical custody refers to living arrangements and visitation schedules.
As a general rule, family courts will try to avoid revoking legal or physical custody for either parent, unless it is in the child’s best interest for them to do so. Joint custody is preferred, but the parenting schedule usually isn’t split exactly in half. Instead, the judge will review a list of factors and determine which parent will be the primary “custodial parent,” and which parent will have visitation rights.
Courts will determine custody based on the following factors:
- The fitness of each parent to care for a child
- The quality of the child’s current home environment
- History of violence or abuse from either parent
- Proximity to school, healthcare facilities, and other necessities
- The child’s preference and relationship with each parent (when applicable)
